Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of the Mia Doula website, application, and AI doula and pregnancy-tracking services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Accounts

You must create an account to use Mia Doula. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You must provide accurate information and notify us promptly of any unauthorized use. You must be at least 16 years old to create an account.

3. Subscriptions and billing

Mia Doula offers free and paid subscription plans. Paid plans are billed in advance on a weekly or annual basis through Stripe. By subscribing, you authorize us to charge your payment method on each billing date until you cancel.

Cancellation. You may cancel your subscription at any time from your profile. Cancellation takes effect at the end of the current billing period; you retain access until then.
Refunds. Subscription fees are non-refundable except where required by law. If you believe a charge was made in error, contact us within 14 days and we will review it.
Price changes. We may change subscription prices with at least 14 days' notice. Continued use after the notice period constitutes acceptance of the new price.

4. Credits

Some features consume credits. Credits are allocated based on your subscription plan and do not roll over between billing periods unless stated otherwise. Unused credits expire at the end of your billing period. Credits have no monetary value and cannot be transferred or exchanged for cash.

5. AI-generated content

Mia Doula uses AI models to provide pregnancy guidance and answers from your questions. You retain ownership of the inputs you provide (your questions and the pregnancy details you photos). With respect to the AI-generated output images:

You are granted a non-exclusive, worldwide license to use, share, and publish images generated under your account for personal and commercial purposes, subject to these Terms.
You may not claim that AI-generated images are entirely human-made where disclosure is required by law or platform policy.
We do not guarantee that generated content is unique. Similar prompts from different users may produce similar outputs.
You are solely responsible for ensuring that your use of generated content complies with applicable laws and third-party rights.

6. Your content and uploads

By entering questions or pregnancy details, you grant Mia Doula a limited, non-exclusive license to store and process that content solely to provide the Service to you. We do not use your uploads or prompts to train AI models. You represent that you have the right to upload any content you submit and that it does not violate any third-party rights.

7. Acceptable use

You agree not to use the Service to generate, upload, or distribute content that:

Is illegal, defamatory, obscene, or violates any third-party rights;
Depicts minors in a sexual manner;
Constitutes harassment, hate speech, or incitement to violence;
Infringes copyright, trademark, or other intellectual property rights;
Contains malware or attempts to harm our systems or other users.

We reserve the right to remove content and suspend or terminate accounts that violate these rules without prior notice.

8. Intellectual property

The Mia Doula platform, including its branding, design, software, and underlying technology, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, reverse-engineer, modify, or distribute our platform or technology without our written permission.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.

Mia Doula provides AI-powered pregnancy tracking and AI doula support for personal and creative use. AI-generated content is produced algorithmically and may not always be accurate or suitable for all audiences — review outputs before publishing or distributing them.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIA DOULA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (US $50).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

11. Indemnity

You will defend, indemnify, and hold harmless Mia Doula and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.

12. Termination

We may suspend or terminate your access to the Service at any time for violations of these Terms or for any other reason with reasonable notice, except that we may act immediately for serious violations. On termination, your right to use the Service ceases. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnity) will survive.

13. Changes to the Service or Terms

We may modify the Service or these Terms at any time. We will post updated Terms on this page and update the "Last updated" date. For material changes, we will notify you by email or in-app at least 14 days before they take effect. Continued use after changes constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules. Any disputes will be resolved in the courts of the jurisdiction where Mia Doula's operating entity is organized, except where prohibited by law.
